We provide these templates entirely as a free community service aimed at keeping Florida families protected. At our core, we specialize in Probate Court administration, helping families wrap up estates after a loss. Because each day we focus on managing estates in court, we see firsthand how the proper planning prevents administrative headaches.

A Lady Bird Deed, formally known as an Enhanced Life Estate Deed, allows a property owner to automatically, upon death, transfer real estate to a named beneficiary without going through probate court. Unlike traditional life estate deeds, the owner retains total control over the property during their lifetime. This includes the right to sell, mortgage, lease, or gift the property without needing the beneficiary’s consent.

Core Statutory Rules & Requirements

  • Execution Formalities (F.S. § 689.01): A valid real estate deed in Florida requires the signature of the Grantor made in the presence of at least two disinterested subscribing witnesses.
  • Recording & Identification Block (F.S. § 695.26): Every deed recorded within public records must explicitly name the preparer who drafted the instrument and provide a mailing address where the original recorded document should be returned.
  • Witness & Notary Requirements (F.S. § 695.26): This requires that subscribing witnesses must include their printed names and official mailing addresses beneath their signatures. A Notary Public must also acknowledge the Grantor’s signature via physical presence or Remote Online Notarization (RON).
  • Exact Legal Description Requirement: Street addresses (911 addresses) are considered insufficient for deed conveyances. The document must include the precise metes and bounds or platted lot legal description copied verbatim from a prior recorded warranty deed in order to avoid clouding the title.

Key Structural Components of a Lady Bird Deed

  • Grantor (Current Owner): This is the individual currently holding title who will transfer the future remainder interest. The name must match official county records exactly.
  • Grantee Beneficiary (Remainderman): The person or entity that is designated to automatically inherit the real estate immediately upon the Grantor’s death by operation of law.
  • Enhanced Life Estate Reservation Clause: The crucial clause that distinguishes a Lady Bird Deed. It explains that the Grantor reserves full lifetime ownership rights and the unrestricted power to revoke, alter, sell, or mortgage the property without the Grantee’s permission or signature.
  • Parcel Identification Number (APN): This is the official Assessor’s Parcel Number that is assigned by the local County Property Appraiser for property tax tracking.

Honest and straight forward assessment of complex case. My case span both federal and state issues, as well as civil case of fraud which maybe criminal fraud. The world of probate can be fairly daunting for one who has little to no experience. Between trying to figure out what to file and when to file, there is also the where. I was quite relieved to have Nadine and Cary to guide me through the court process.

I highly recommend using this law group for your Florida probate needs, and in particular, Charles David. He explained clearly what my 91 year old aunt would need to do in order to sell property that was in hers and her late husband's name.
